General Terms and Conditions (GTC) of TMLSTUDIO

1. Scope

These general terms and conditions (hereinafter "GTC") apply to all orders placed by consumers and entrepreneurs via the TMLSTUDIO online shop (hereinafter "we" or "us"). A consumer is any natural person who concludes a legal transaction for purposes that can predominantly not be attributed to their commercial or independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.

2. Contracting parties, conclusion of contract

The purchase contract is concluded with TMLSTUDIO , owner: Lenny Schift, Mainhardt.

  • The presentation of the products in the online shop does not constitute a legally binding offer, but a non-binding invitation to place an order.
  • By clicking the "Buy now" button you place a binding order for the goods in your shopping cart. The order confirmation will be sent by email immediately after the order has been sent and does not constitute acceptance of the contract.
  • A purchase contract is only concluded when we accept your order by a separate declaration of acceptance via email or by dispatching the goods within two days.

3. Prices and payment terms

  • All prices in the online shop are stated in euros and include VAT.
  • Shipping costs, if applicable, will be shown separately during the ordering process.

4. Shipping and delivery conditions

  • We ship worldwide unless otherwise stated. Delivery times and shipping costs vary depending on destination and are displayed during the order process.
  • Within Germany, the delivery time is usually 3-5 working days, internationally 7-20 working days. However, this information may vary depending on the destination country and delivery service provider.
  • If delivery to the customer fails for reasons for which the customer is responsible (e.g. incorrect address information), the customer will bear the costs for re-shipment.

5. Retention of title

The delivered goods remain our property until full payment has been made.

6. Right of withdrawal

7. Returns

Customers have the right to exercise their right of return within 14 days of receiving the goods. Returns within Germany are free of charge. For more information, see our return policy .

8. Warranty and liability

  • The statutory liability for defects applies.
  • We are liable without limitation for claims based on damages caused by us, our legal representatives or vicarious agents:
    • in case of injury to life, body or health,
    • in the event of intentional or grossly negligent breach of duty,
    • in the case of guarantee promises, if agreed,
    • insofar as the scope of application of the Product Liability Act is open.

9. Disclaimer

We are only liable for slightly negligent breaches of duty if essential contractual obligations (cardinal obligations) are violated. Cardinal obligations are those whose fulfillment makes the proper execution of the contract possible in the first place and on whose compliance the customer can regularly rely. In this case, however, our liability is limited to the foreseeable damage typical for the contract.

10. Data protection

We treat your personal data confidentially and in accordance with the statutory data protection regulations and our privacy policy .

11. Dispute settlement

The European Commission provides a platform for online dispute resolution (ODR), which you can find here: https://ec.europa.eu/consumers/odr . We are prepared to participate in an out-of-court dispute resolution procedure before a consumer arbitration board.

12. Final provisions

  • The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
  • Should individual provisions of these General Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
